Introduction

DomainBrainstorm.io (the “Service”) is provided by Solid Technologies AG (“Company,” “we,” “us,” or “our”). These Terms of Use (the “Terms”) govern your access to and use of the DomainBrainstorm.io website, services, and features. By accessing or using the Service, you agree to these Terms. If you do not agree, you may not use the Service.

1. Acceptance of the Terms

DomainBrainstorm.io provides idea-generation tools to brainstorm brand and project names and to check domain name patterns and availability signals (including optional “domain hack” patterns) via third-party providers. Core features may include:

We do not perform domain registrations and do not guarantee that any domain you see is actually available at purchase time. Final availability and prices are determined by registrars or marketplaces.

4. Accounts and Security

  1. Accounts (optional): Some features (e.g., saving lists) may require an account. You agree to provide accurate, current, and complete information.
  2. Security: You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly of any unauthorized use.

5. User Content

  1. Ownership: Inputs you provide (e.g., prompts, lists, names) and any other material you submit (“User Content”) remain yours. You represent you have the rights necessary to submit the User Content.
  2. License to us: You grant Solid Technologies AG a non-exclusive, worldwide, royalty-free license to store, display, reproduce, and process your User Content solely to operate, secure, and improve the Service.
  3. Responsibility: You are solely responsible for your User Content and for ensuring it does not violate laws or third-party rights.
  4. Moderation: We may remove or restrict content that violates these Terms or that we reasonably find objectionable.

6. Intellectual Property

  1. Our IP: The Service (including software, models, designs, and documentation) is owned by or licensed to Solid Technologies AG and is protected by applicable IP laws. Except as permitted by law, you may not copy, modify, distribute, reverse engineer, or create derivative works without our prior written consent.
  2. Trademarks: All trademarks, service marks, and trade names (including “DomainBrainstorm.io” and “Solid Technologies AG”) are our property or used under license. You may not use them without our express written permission.

7. Acceptable Use

You agree not to:

  1. Violate laws or third-party rights (including IP rights).
  2. Upload or distribute unlawful, defamatory, harassing, hateful, or otherwise objectionable content.
  3. Introduce malware, attempt to bypass security or access non-public areas of the Service or our providers’ systems.
  4. Scrape, crawl, or perform automated queries (including bulk availability checks) without our prior written consent or in ways that overload or interfere with the Service or third-party providers.
  5. Circumvent rate limits, usage restrictions, or technical protections.

8. Domain Availability & Third-Party Sources

Availability information and other data may come from third-party providers and may be cached or delayed. We do not guarantee accuracy, completeness, or real-time status. A domain shown as “available” may no longer be available at checkout, and prices may differ. We are not responsible for actions or omissions of registrars, marketplaces, or other third parties.

9. Termination

  1. By you: You may stop using the Service at any time and request deletion of your data as described in the Privacy Policy.
  2. By us: We may suspend or terminate access at any time for any reason, including violations of these Terms. We will try to notify you when reasonable.
  3. Effect: Upon termination, your right to use the Service ends. Provisions that by their nature should survive will survive.

10. Disclaimers

  1. As-is: The Service is provided “as is” and “as available” without warranties of any kind.
  2. No guarantees: We do not guarantee uninterrupted, secure, or error-free operation or that content will not be lost.
  3. Infrastructure: The Service runs on third-party infrastructure (e.g., Firebase/Google). We are not responsible for outages or data loss caused by third parties.

11. Limitation of Liability

  1. Indirect damages: To the fullest extent permitted by law, Solid Technologies AG is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits.
  2. Cap: Our total liability will not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to liability, or (b) one hundred US dollars (USD 100).
  3. Jurisdictions: Some jurisdictions do not allow certain limitations; in such cases, those limitations apply only to the extent permitted.

12. Indemnification

You will indemnify and hold harmless Solid Technologies AG and its officers, employees, and agents from any claims, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your User Content, or your violation of these Terms.

13. Governing Law & Venue

  1. Law: These Terms are governed by the laws of Switzerland, excluding conflict-of-law rules.
  2. Venue: The exclusive venue for disputes is Lucerne, Switzerland. You consent to the personal jurisdiction of those courts.

14. Changes to the Terms

We may change these Terms at any time in our discretion. Material changes will be posted on the website with an updated “Last updated” date. Your continued use of the Service constitutes acceptance of the updated Terms.
